VirtualBLS Terms of Service Last Updated: March 2026

Welcome to VirtualBLS. By accessing or using the hosted service at VirtualBLS.net (the “Service”), you agree to be bound by these Terms of Service.

1. Software Licensing & Open Source

The core software driving the VirtualBLS game engine is licensed under the GNU Affero General Public License v3.0 (AGPLv3).

  • You may access the source code for the game engine via our public repository.
  • While the software logic is open-source, your access to the hosted platform at VirtualBLS.net, including user dashboards, directory management, and technical support, is a proprietary service provided by Collingwood Enterprises, LLC.

2. Intellectual Property & Branding

“VirtualBLS,” the VirtualBLS logo, the website’s visual design (Elementor layouts), and all non-code content are the sole property of Collingwood Enterprises, LLC unless otherwise specified. Your right to use the Service does not grant you any ownership or trademark rights in these elements.

3. Professional Eligibility & Use

The Service is a clinical tool intended exclusively for professional use. By using the Service, you represent and warrant that:

  • Licensure: You are a licensed mental health professional in good standing with your respective governing board.
  • Training: You have received formal training in EMDR (Eye Movement Desensitization and Reprocessing) therapy.
  • Clinical Judgment: You assume all responsibility for determining the clinical appropriateness of this tool for each individual client.
  • Prohibited Use: Self-administration of EMDR via this tool without a trained clinician is strongly discouraged and at your own risk.

4. “Beta” Status & Service Reliability

VirtualBLS is currently in Beta. You acknowledge that the Service may contain bugs, experience downtime, or undergo frequent updates.

  • Collingwood Enterprises, LLC, does not guarantee that the Service will be uninterrupted or error-free.
  • You are responsible for having a “back-up” clinical plan (e.g., manual lightbar, hand-tapping) should the technology fail during a session.

5. Privacy & Data Security

  • Clinician Data: We collect minimal information (Name, Email, Payment Info) to maintain your account. We use Google Analytics on the administrative dashboard only to improve the service.
  • Client Data: VirtualBLS does not collect, store, or transmit Protected Health Information (PHI) or personal data regarding your clients. The client-facing game page is designed to be data-neutral.
  • Security: You are responsible for maintaining the confidentiality of your login credentials.

6. Limitation of Liability & No Medical Advice

VirtualBLS IS A TECHNOLOGY TOOL, NOT A MEDICAL DEVICE OR A CLINICAL PROVIDER.Collingwood Enterprises, LLC, provides no medical advice or guarantees regarding treatment outcomes. To the fullest extent permitted by law, Collingwood Enterprises, LLC, shall not be liable for any direct, indirect, or consequential damages (including psychological harm or clinical setbacks) resulting from the use or inability to use the Service.

You agree to indemnify and hold harmless Collingwood Enterprises, LLC, from any claims arising from your professional application of the tool with clients.
